We at Mediquince also reserve the right to use the information either provided by the end-user or provided about the end-user for the below-mentioned purposes:

5.1.4 We require your express consent to collect, use and disclose information that has been designated in nature as Personal Information, Sensitive Personal Data, or Information under the SPI Rules. You consent to using, collecting, and disclosing information as required under applicable law by affirming our Privacy Policy.
5.1.5 The responsibility to maintain the accuracy of the information submitted to us by you, like your contact details provided to us as part of account registration. If your personal information changes, you may update, delete inaccuracies, or correct information by making changes on our member information page or contacting us through support@mediquince.com. We will make the requested changes in our then-active databases as soon as possible. However, in case you provide any information that is inaccurate, incomplete, untrue, or out of date (or becomes inaccurate, incomplete, untrue, or out of date), or Mediquince has reasonable grounds to suspect that the information provided by you is incomplete, inaccurate, untrue, or out of date, Mediquince may, at its sole discretion, discontinue or stop the provision of the Services to you. Under certain circumstances, Mediquince will not update, correct, or delete your Personal Data, including (a) the said Personal Data is in documents related to a prosecution if all proceedings concerning the prosecution have not been completed, and (b) where the Personal Data is opinion data that is kept solely for the evaluative purpose.
5.1.6 Mediquince does not control or endorse the messages, information, or content found in any Services. Therefore, Mediquince expressly disclaims any liability in relation to the Services and any actions resulting from your participation in any Services. You agree to waive any claims against Mediquince relating to the same and to the extent that such waiver may be ineffective. You also agree to release any claims against Mediquince relating to the same.
5.1.7 If you wish to deactivate your account or no longer want us to use your information to offer you services, you can get in touch with us through support@mediquince.com. Your information will be retained by us for as long as your account is active and as needed to provide you services. However, the information shall not be retained for longer than is required for the purposes for which we may use the information lawfully or is otherwise required by under any other law currently in force. After a certain period, we will anonymise and aggregate your data and then retain the data for as long as necessary to offer our Services effectively, but we will solely use anonymised data for analytic purposes. Deactivation of your account or withdrawal of consent may result in Mediquince being unable to offer you its services or terminate any existing relationship Mediquince may have with you.
5.1.8 You can mail us at support@mediquince.com if you wish not to receive promotional or marketing-related information regarding Services.
5.1.9 Mediquince may require the User to pay with a debit/credit card, cheque, or wire transfer, for Services for which subscription amount(s) is/are payable. Accordingly, we will collect such User's credit card number and/or other information like bank account numbers and will use it for the billing and payment processes, including but not restricted to the use and/or disclosure of such credit card number and details to third parties as necessary to complete such billing operation. However, verification of credit information is accomplished solely by the User through the authentication process. Furthermore, we digitally transact the User's credit card/debit card details upon secure sites of approved payment gateways under encryption, hence providing the highest possible degree of security as per current technology. However, Mediquince gives you an option not to save your payment details. However, we advise the user that internet technology is not fully safe, and the User should exercise discretion on using the same.
5.1.10 As a result of the communications standards on the Internet, when anyone, including a User or the End-User, visits the Website, Mediquince automatically receives the site URL from which they visit. In addition, we receive the Internet Protocol (IP) address of each User's computer (or the proxy server used to access the World Wide Web by a user), the User's computer operating system and browser type used by the User, email patterns, and the name of User's ISP. We use this data to analyze overall trends to improve our Service. The linkage between the User's personally identifiable information or the User's IP address is not shared with or disclosed to third parties. Notwithstanding the above, Mediquince may share and/or disclose some of the aggregate findings (not the specific data) in an anonymized manner (i.e., non-personally identifiable) with strategic partners, investors, advertisers, sponsors, and others to help grow our business.
5.1.11 Temporary cookies are used by the website to store certain information (that is not sensitive personal data or information) that Mediquince and our service providers use for the website's technical administration, research and development, and User administration. In serving advertisements or optimizing services to its Users, we may allow authorized third parties to recognize or place a unique cookie on the browser of the User. 5.1.12 In the absence of an account on the website, a User may have limited access to the Website. Unregistered Users can book appointments with the doctors by sharing their names and phone number. A User is required to first create an account on our Website to access all the features and benefits on our Website. A User needs to provide the following information, which such User recognizes and expressly acknowledges is Personal Information allowing others, including Mediquince, to identify the User: name, age, phone number, country, ZIP/postal code, email address, password chosen by the User, the User ID, and valid financial account information to create an account. Other information needed on the registration page, including the ability to receive promotional offers from Mediquince, is optional. Mediquince may, in the future, include other optional requests for information from the User to help itself customize the Website to deliver personalized information to the User.
5.1.13 This Privacy Policy applies to Services owned and operated by Mediquince. We at Mediquince do not exercise control over the sites displayed as search results or links within its Services. We will not be responsible if these other websites place their cookies or other files on the computer of the User, solicit personal information or collect data from the User. Accordingly, Mediquince does not make any representations concerning such third parties' privacy practices or policies or terms and conditions of use of such websites, nor does we guarantee the accuracy, integrity, or quality of the data, information, text, photographs, videos, software, sound, graphics, messages or other materials available on such websites. 5.1.14 The Website may enable the User to communicate with other Users or to post information that others can access, where such data may be collected by other Users. Such Users, including any administrators or moderators, are not authorized Mediquince representatives or agents, and the opinions or statements of such users do not necessarily reflect those of Mediquince, and they are not authorized to bind Mediquince to any contract. Mediquince hereby explicitly disclaims any liability for any reliance or misuse of such information being made available by Users or visitors in any manner.
5.1.15 Mediquince does not collect information about the Website visitors from other sources, such as private organisations or public records or bodies, save and except for user registration (each End User must agree to the collection, use, storage, and disclosure of which under the Terms of Use for Mediquince to render the Services effectively).
5.1.16 Mediquince maintains a strict "No-Spam" policy, which means that we have no intention of selling, renting, or otherwise sharing your email address with a third party without your consent.
5.1.17 To protect the personal data that Mediquince has under its control from improper use or disclosure, unauthorised modification, unauthorised access, unlawful modification, and accidental loss, we at Mediquince have adopted the best international market practices and security policies, rules, and technical measures. However, for any loss of data or theft due to unauthorized access to the electronic devices of the user through which they avail the Services, Mediquince shall not be held liable for any loss whatsoever incurred by the User.
5.1.18 Mediquince implements reasonable security practices and procedures and has a comprehensively documented information security program and information security policies that contain operational, technical, managerial, and physical security control measures proportional to the information being collected and the nature of Mediquince's business.

Therefore, other than as expressly stated in this Privacy Policy, will only disclose your Personal Information; if it is necessary to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority, or similar requirements or when Mediquince, in its sole discretion, deems it necessary to protect Mediquince's rights or the rights of others, to fight fraud and credit risk, to prevent harm to people or property, or to enforce or apply the Terms of Use.
5.2 Practitioners Note:
This section applies to all Practitioners.
5.2.1 As part of the registration and the application creation and submission process that is available to Practitioners on Mediquince, certain information, including Personal Information or Sensitive Personal Data or Information, is collected from the Practitioners.
5.2.2 All the statements in this Privacy Policy apply to all Practitioners. Therefore, all practitioners must read and understand the privacy statements set out herein before submitting any Information or Personal Information or Sensitive Personal Data to Mediquince, failing which they are required to leave the Services, including the Website, immediately.
5.2.3 Personally identifiable information of Practitioners, which they choose to provide to Mediquince, helps the Practitioners describe and identify themselves. Mediquince exclusively owns this information. You will be the owner of your data, and you provide Mediquince the consent to collect, use, process, and/or disclose this data for the purposes hereinafter stated. Mediquince may use such information for commercial purposes, and in an aggregated or non-personally identifiable form for statistical analysis, research, and business intelligence purposes, and may sell or otherwise transfer such statistical, research, or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. Mediquince also reserves the right to use the information provided by or about the Practitioner for the following purposes:

5.2.4 Mediquince automatically lists practitioners' information on its Website for every 'Doctor' or 'Clinic' that they added to a Practice using its software. The Practitioner information listed on the Website is displayed when End-Users search for doctors on the Website. End-Users use the Practitioner information listed on the Website to request doctor appointments. Mediquince does not generate any personally identifiable information of the Practitioners listed on the Website. It is provided to Mediquince by Practitioners who wish to enlist themselves on the Website or is collected by Mediquince from the public domain. Mediquince displays such information on its Website on an as-is basis and makes no representation or warranty on the information's accuracy or completeness. We advise Practitioners to check the accuracy and completeness of their information time and again and immediately bring to our notice if there are any discrepancies, changes, or updates to such information. However, Mediquince will take reasonable steps to ensure the accuracy and completeness of this information.
5.2.5 Mediquince may also display information for Practitioners who have not registered or signed up for the Services, provided that the Practitioners have consented to Mediquince to collect, process, and/or disclose their information on the Website. Mediquince or its associates verify such Practitioners, and we make every effort to capture accurate information for such Practitioners. However, Mediquince does not undertake any liability for any incorrect or incomplete information appearing on the Website for such Practitioners.
5.3 Casual Visitors Note:
5.3.1 Mediquince automatically collects no sensitive personal data or information from any casual visitors of our website who are merely perusing the Website.

9. Permissions
Once our application is downloaded and installed by You, we will prompt You to grant certain permissions to let the Application perform certain actions on Your device. These actions include permission to:

Mediquince is not responsible for any errors, omissions or representations on any Linked Site. Mediquince does not endorse any advertiser on any Linked Site in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.
11. Governing law
This agreement and each TOS shall be governed by and constructed in accordance with the laws of india without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Mumbai.
12. Prohibition against unlawful use
As a condition of the use of the Website, the User warrants that they will not use the Website for any purpose that is unlawful or illegal under any law for the time being in force within or outside India or prohibited by this Agreement and/or the TOS including both specific and implied. In addition, the Website shall not be used in any manner, which could damage, disable, overburden or impair it or interfere with any other party's use and/or enjoyment of the Website. The User shall refrain from obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for or through the Website
13.Online Payment
We use Razorpay and Paypal for processing online payments. We/Razorpay and Paypal do not store your card data on their servers. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment. Your purchase transaction data is only used as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is not saved.
Our payment gateway adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

14. Fee Payment
Mediquince reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the Mediquince Services. Mediquince further reserves the right to alter any and all fees from time to time, without notice.
The User shall be liable to pay all applicable charges, fees, duties, taxes, levies and assessments for availing the Mediquince Services.
15. User Obligations
In consideration of use of the Website, the User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from using the Website and/or receiving the Services under the laws of India or other applicable law.
To avail a Service the User has and must continue to maintain at his sole cost: (a) all the necessary equipments including a computer and modem etc. to access the Website/avail Services (b) own access to the World Wide Web. The User shall be responsible for accessing the Services and that access may involve third party fees including, airtime charges or internet service provider's charges which are to be exclusively borne by the User.
The user also understands that the services may include certain communications from Mediquince as service announcements and administrative messages. the user understands and agrees that the services are provided on an "as is" basis and that Mediquince does not assume any responsibility for deletions, miss-delivery or failure to store any user communications or personalized settings.
Registration of the User on the Website is optional. If the User opts to register himself on the Website, upon completion of the registration process, the User shall receive a user id and password.
The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party's user id and password for any purpose whatsoever without proper authorization from such party. You are responsible for the security of your password and for all transactions undertaken using your password through our service. The Password entered by you is transmitted in one- way encrypted form to our database and stored as such. Thus the Password will not be known even to Mediquince. You confirm that you are the authorised holder of the credit card or the original account holder used in the transactions you make using the Mediquince services.
